2. Description of Service

Tryly.ai provides AI-powered fashion photography services that transform product photos into professional model photographs. Our service uses artificial intelligence to generate realistic images of clothing items on professional models.

Important Notice: All generated photos are AI-created and use artificial intelligence technology. The models featured in generated images are not real people and are entirely created by AI.

3. Credit System and Payment

Our Service operates on a credit-based system:

  • Credits are purchased in packages (Starter, Professional, Business)
  • Each photo generation consumes one (1) credit
  • Credits never expire once purchased
  • Credits are non-transferable between accounts
  • All payments are processed securely through Stripe

4. Refund Policy

All sales are final. By purchasing credits on Tryly.ai, you acknowledge and agree that all purchases are final and non-refundable under any circumstances.

4.1 Policy Overview

Tryly.ai operates a no refund policy for all credit purchases and services.

This means:

  • Once you purchase credits, the sale is final
  • We do not offer refunds for any reason
  • Credits cannot be exchanged for cash or transferred to other accounts
  • Unused credits remain in your account but cannot be refunded
  • Dissatisfaction with results does not qualify for a refund

4.2 Rationale

  • Digital Service: Once credits are used to generate photos, the AI processing has been completed and cannot be reversed
  • Instant Delivery: You receive generated photos immediately, making the service non-returnable
  • Free Trial Available: We offer free credits to test the service before purchasing
  • Fair Pricing: Our credits are already priced at 99% less than traditional photoshoots
  • Credits Never Expire: Your purchased credits remain in your account indefinitely

4.3 Situations Where Refunds Are NOT Granted

We do NOT issue refunds in the following situations:

  • Change of Mind: If you decide you no longer want the service after purchasing
  • Dissatisfaction with Results: If you're unhappy with the quality of generated photos (you can regenerate with different settings)
  • Unused Credits: If you purchased credits but haven't used them yet
  • Better Price Found: If you find a competitor with lower pricing
  • Service Cancellation: If you decide to stop using the service
  • Account Closure: If you close your account voluntarily or due to terms violations
  • Technical Learning Curve: If you need time to learn how to use the service effectively
  • Upload Mistakes: If you accidentally uploaded the wrong photos
  • Business Changes: If your business needs change and you no longer need the service

4.4 Credit Restoration

While we do not offer monetary refunds, we will restore credits to your account in these specific cases:

  • Failed Generations: If the AI fails to generate a photo due to system errors, credits are automatically restored
  • Technical Errors: If our service has a technical issue preventing generation, credits will be returned
  • Duplicate Charges: If you're accidentally charged twice for the same purchase, we'll restore the duplicate charge as credits
  • Service Outages: If credits are consumed during a service outage, they'll be restored

Note: Credit restoration means credits are returned to your account balance, not as a monetary refund.

4.5 Before You Purchase - Important Recommendations

To ensure you're satisfied with our service before purchasing:

4.6 Chargebacks and Disputes

Chargebacks are violations of our Terms of Service:

  • Filing a chargeback or payment dispute instead of contacting us directly is prohibited
  • Accounts that file chargebacks will be immediately terminated
  • We will provide full documentation to your payment provider showing service was delivered
  • Fraudulent chargebacks may result in legal action

5. Photo Authenticity and Quality

All generated photos are AI-created:

  • Generated images are created by artificial intelligence and do not feature real models
  • Photos are provided for commercial use in fashion and e-commerce
  • While we strive for high quality, AI-generated content may occasionally have imperfections
  • Results depend on the quality of your uploaded product photos
  • We do not guarantee specific results or exact replication of your expectations

Photo Standards:

  • All generated photos are provided in HD quality (600×600 pixels)
  • We maintain professional standards for all AI-generated content
  • Photos are suitable for commercial use on e-commerce platforms
  • Quality may vary based on input photo quality and complexity

6. User Conduct and Acceptable Use

You agree to use our Service responsibly and professionally. The following actions are strictly prohibited:

  • Upload only fashion and clothing product photos
  • Do not upload inappropriate, offensive, or illegal content
  • Do not attempt to abuse, exploit, or reverse-engineer our AI technology
  • Do not use the Service to create misleading or deceptive content
  • Respect intellectual property rights when uploading product photos
  • Do not create multiple accounts to obtain additional free credits or circumvent usage limits. Each individual or business entity is permitted one (1) account only
  • Do not use disposable, temporary, or alias email addresses to create additional accounts
  • Do not use VPNs, proxies, or other tools to mask your identity for the purpose of creating multiple accounts or evading enforcement actions
  • Do not share, transfer, or sell account credentials or credits to third parties
  • Do not use automated tools, bots, or scripts to interact with the Service

Any violation of these rules will result in immediate and permanent account termination, forfeiture of all credits, and may result in legal action including but not limited to civil damages and criminal referral.

7. Fraud Detection, Anti-Abuse & Legal Enforcement

Zero Tolerance Policy — Enforced Worldwide

Tryly.ai employs advanced, multi-layered fraud detection and abuse prevention systems to protect the integrity of our platform and our paying customers. These terms apply globally, regardless of where you access the Service from. By using this Service, you acknowledge and consent to the following:

7.1 Monitoring & Detection Systems

Tryly.ai operates enterprise-grade, multi-layered security and fraud detection infrastructure that monitors all platform activity in real time. Our systems employ numerous proprietary detection methods — the specifics of which are confidential and not disclosed for security reasons.

Every action you take on our platform is logged, analyzed, and permanently recorded. Our automated security agents continuously correlate activity across the entire platform to identify abuse. These systems are always active, operate across all accounts and sessions, and cannot be circumvented by any means.

Attempts to evade our detection systems are themselves detected and constitute additional violations that will be used as evidence of willful and deliberate fraud.

7.2 Multi-Account Abuse Policy

Creating multiple accounts to exploit free trial credits or circumvent account restrictions is strictly prohibited and constitutes fraud under applicable international law. This includes:

  • Creating accounts with multiple email addresses for the same person or entity
  • Using disposable, temporary, or alias email addresses to obtain additional free credits
  • Re-registering after account termination under a different identity
  • Having others create accounts on your behalf to obtain free credits for your use

All accounts linked to the same individual or entity will be identified, terminated, and all associated data and generated content will be permanently deleted.

7.3 Evidence Collection & Data Retention

We retain comprehensive, forensic-grade records of all account activity for enforcement and legal purposes. This data is preserved indefinitely and will be used as evidence in legal proceedings, law enforcement investigations, and court filings worldwide.

7.4 Consequences of Abuse — Permanent Ban & Legal Action

If we determine that you have engaged in fraudulent activity, multi-account abuse, or any form of exploitation of our Service, the following actions will be taken immediately and without prior notice or warning:

Immediate Enforcement:

  • Permanent ban — no reinstatement, ever: All accounts associated with the individual or entity will be immediately and permanently terminated. All generated content, uploaded files, and credits (both free and purchased) will be permanently destroyed without refund. All associated devices and network identifiers will be permanently blacklisted from our platform with zero possibility of reinstatement, appeal, or future access
  • Worldwide DMCA takedown enforcement: We will issue DMCA takedown notices and copyright infringement claims to every platform, marketplace, website, hosting provider, and social media account globally where fraudulently obtained content is published — including but not limited to Shopify, Amazon, Etsy, eBay, Instagram, Facebook, TikTok, Pinterest, Alibaba, and any other platform
  • Invoice and debt collection: We will issue an invoice for the full retail value of all AI generations obtained through fraudulent means. Unpaid invoices will be referred to international debt collection agencies and reported to credit bureaus

Legal Action — We Will Prosecute:

  • Civil litigation: We will file civil lawsuits seeking full damages including the value of all stolen services, costs of forensic investigation, platform damages, lost revenue, attorney fees, court costs, and maximum punitive damages permitted by law
  • Criminal prosecution referral: All fraudulent activity will be reported to law enforcement authorities for criminal prosecution under applicable laws, including but not limited to the Computer Fraud and Abuse Act (18 U.S.C. § 1030), wire fraud (18 U.S.C. § 1343), identity fraud, theft of services, and equivalent laws in the abuser's jurisdiction
  • Full cooperation with law enforcement: All forensic evidence collected by our systems — including complete account records, activity logs, device identifiers, network data, behavioral analysis, and cross-account correlation records — will be provided to law enforcement agencies, prosecutors, and courts
  • International legal enforcement: We will pursue legal action in any country and any jurisdiction where the abuser resides, operates a business, or where the fraudulently obtained content is published or used commercially. We work with international legal partners to enforce our rights globally
  • Personal liability: Individuals behind fraudulent accounts will be held personally liable for all damages regardless of whether the abuse was conducted on behalf of a business entity

We have successfully identified and prosecuted abusers in the past, and we will continue to do so. Our legal team actively monitors for fraud. The cost of legal action against you will far exceed the value of any free credits.

7.5 Intellectual Property of Fraudulently Obtained Content

Content generated through fraudulent accounts (including multi-account abuse or exploitation of free trial credits) is not licensed for any use whatsoever. Tryly.ai retains full and exclusive intellectual property rights to all such content worldwide. Any commercial use of content obtained through fraud constitutes copyright infringement and will be pursued through DMCA takedowns, cease and desist orders, and civil litigation in every applicable jurisdiction.

Using fraudulently obtained images on your website, social media, or any commercial platform constitutes ongoing copyright infringement and increases your legal liability with each day of use.

8. Commercial Rights and Licensing

Commercial rights apply only to content generated using legitimately purchased credits:

  • Use generated photos on your website, social media, and marketing materials
  • No attribution required
  • No model releases needed (as models are AI-generated)
  • Unlimited usage rights for commercial purposes

Free Trial Credits — Limited License:

  • Free trial credits are provided solely for evaluation and testing purposes
  • Content generated with free trial credits may be used commercially only if you subsequently purchase a paid credit package
  • Bulk commercial use of content generated exclusively through free trial credits (especially through multiple accounts) is not permitted and constitutes abuse
  • Tryly.ai reserves the right to revoke the license for content generated through free credits if the account is found to be in violation of these terms

Restrictions:

  • You may not resell or redistribute the Service itself
  • You may not claim that AI-generated models are real people
  • You must comply with applicable advertising laws regarding AI disclosure
  • You may not remove, alter, or obscure any metadata or watermarks embedded in generated content
  • Commercial rights are immediately and permanently revoked upon any violation of these Terms of Service

9. Data Security and Privacy

We take your privacy and security seriously:

  • All uploaded photos are encrypted and securely stored
  • Your photos are private and not shared with third parties
  • Payment information is processed securely through Stripe
  • We comply with industry-standard security practices

10. Service Availability

While we strive for 99.9% uptime:

  • Service may be temporarily unavailable for maintenance
  • We do not guarantee uninterrupted access
  • Downtime does not entitle users to refunds
  • We will notify users of planned maintenance when possible

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Tryly.ai is provided "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount paid for credits in the past 12 months
  • We are not responsible for business losses, revenue loss, or opportunity costs

12. Account Termination and Enforcement

We reserve the right to take the following actions without prior notice:

  • Suspend or terminate accounts that violate these terms
  • Remove content that violates our acceptable use policy
  • Refuse service to anyone for any reason
  • Permanently block devices and IP addresses associated with abuse
  • Retain all account data and activity logs as evidence for legal proceedings
  • Report fraudulent activity to law enforcement authorities
  • Issue DMCA takedown notices for content generated through fraudulent accounts
  • Pursue civil litigation for damages resulting from abuse of our Service

No refunds will be issued for terminated accounts. All credits — both free and purchased — are forfeited upon termination for Terms of Service violations.

Termination of your account does not limit our right to pursue any other remedies available to us under law or equity.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes constitutes acceptance of the new terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
