Tryly.ai provides a virtual try-on widget that allows e-commerce merchants to offer their customers the ability to virtually try on apparel items. The Service includes:

  • JavaScript widget integration for e-commerce platforms
  • AI-powered virtual try-on technology
  • Analytics and usage tracking
  • Customization options for widget appearance

3. Account Registration

To use our Service, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

4. Acceptable Use Policy

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Transmit any malicious code or interfere with the Service
  • Attempt to reverse engineer or copy our technology
  • Use the Service to process inappropriate or offensive content
  • Exceed your subscription plan's usage limits

5. Subscription and Billing

Our Service is offered on a subscription basis with various pricing tiers:

  • All plans include a 7-day free trial - no charges during trial
  • Monthly subscriptions: Cancel anytime, service continues until period end
  • Billing handled through Shopify for Shopify merchants
  • Credits reset monthly on your billing date
  • Contact support@tryly.ai for any billing concerns
  • When monthly credits are exhausted, 10 grace credits activate automatically
  • Grace credits ensure uninterrupted service for your customers

6. Intellectual Property

All content, features, and functionality of the Service are owned by Tryly.ai and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our Service without explicit permission.

7. Privacy and Data Protection

Your use of our Service is also governed by our Privacy Policy. We are committed to protecting your privacy and handling your data responsibly. We do not collect or store customer personal information from your e-commerce platform.

8. Widget Integration

When integrating our widget on your e-commerce platform:

  • You grant us permission to display the widget on your website
  • You are responsible for ensuring compatibility with your platform
  • You must not modify the widget code without authorization
  • You agree to display any required attribution

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRYLY.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Tryly.ai from any claims, losses, damages, liabilities, and expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account for:

  • Breach of these Terms (with 7 days to remedy)
  • Non-payment after grace period
  • Fraudulent or illegal activity (immediate)
  • Extended inactivity (6+ months, with 30 days notice)

12. Modifications to Service

We reserve the right to modify or discontinue the Service at any time. We will provide reasonable notice of any significant changes that may affect your use of the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.
